Special Education Policies

Escuela Avancemos! will ensure that all children with disabilities within the boundaries of Escuela Avancmeos!, including children with disabilities who are homeless or wards of the State, and children with disabilities attending private schools or who are home schooled, and who are in need of special education and related services are identified, located and evaluated.

Confidentiality

Escuela Avancemos! will ensure that protection of the confidentiality of any personally identifiable data, information, and records collected or maintained by the agency will be in accordance with the IDEA regulations 340.1701-340.1862.

Discipline

A child with a disability may be disciplined for a violation of the student code of conduct, including removal from his or her current placement to an appropriate interim alternative educational setting, another setting, suspension, or expulsion in accordance with IDEA Regulations Appendix A and B.

Evaluation And Eligibility

A full and individual initial evaluation will be conducted by Escuela Avancemos! before the initial provision of special education and related services to a child with a disability in accordance with 340.1721-340.1725 of the IDEA regulations. A reevaluation of each child with disability will be conducted by Escuela Avancemos! and Special Education Department in accordance with 340.1721-340.1725 of the IDEA regulations.

Free And Eligibility

A free appropriate public education(FAPE) will be available to all children within the boundaries of responsibility of Escuela Avancemos!, including children with disabilities who have been suspended or expelled from school as provided for in 300.101 of the IDEA regulations

Individualized Education Program (IEP)

Escuela Avancemos! shall ensure that an IEP is developed and implemented for each eligible child served by Escuela Avancemos! and for each eligible child placed in or referred to a private school or facility by Escuela Avancemos! in accordance with 300.22 of the IDEA regulations.

Least Restrictive Environment (LRE)

Children with disabilities, including children in public or private institutions or other care facilities, will be educated to the maximum extent appropriate with children who are not disabled in accordance with 300.114 of the IDEA regulations.

Procedural Safeguards

Escuela Avancemos! will establish, maintain, and implement procedural safeguards that meet the requirements of 300.504 of the IDEA regulations.
